01Check eligibility for independent stay after family residence

What to do

Samostalni boravak is not a savings-based permit open to everyone. Article 59 concerns autonomy after family reunification: normally after four continuous years, three following the sponsor's death, with exceptions for violence or particularly difficult circumstances. Without previous family residence, use another lawful ground.

Where to go

Local MUP foreigners unit

What to prepare

  • Previous family-reunification cards/decisions and residence timeline
02Document family history or the exception

What to do

List the periods of family residence. Include the death record if that is your branch, or competent-service evidence of exceptional hardship. In an immediate safety threat, contact emergency services first rather than waiting to prepare an immigration file.

Where to go

Civil registry, MUP, social work centre or court, depending on the evidence

What to prepare

  • Civil records and evidence for the applicable Article 59 branch
  • Entry passport and stamped pages
  • Serbian address evidence and owner's consent where applicable
03Apply for independent status, not a new family application

What to do

Select Independent stay in the official process and submit evidence for your branch. For exceptional cases, ask MUP to identify the applicable maintenance and insurance requirements: statutory exceptions mean one mandatory checklist cannot fit every applicant.

Where to go

eForeigner or permitted in-person filing with MUP

What to prepare

  • Entry passport and stamped pages
  • Application, family-residence decisions, exceptional-case evidence and documents identified by MUP

Example enquiry

An illustrative example, not an official form. Use the prescribed form where required.

I have family residence through [relationship] since [date]. Circumstances: [description]. Please advise how to apply for independent stay under Article 59 and the documents for my branch.
04Respond to MUP requests and collect the card

What to do

Monitor application messages. Bring originals and your passport to the appointment; biometrics require personal attendance. Check the issued card and set a renewal reminder, obtaining updated evidence that your ground continues.

Where to go

What to prepare

  • Entry passport and stamped pages
  • Original attachments, appointment message and current card for renewal
Translation and filing

Translation and certification

Before translating a foreign-issued record, ask the receiving institution whether it needs a Serbian translation by a court-certified translator (sudski tumač), whether an apostille/legalization is required, and in which order. Requirements differ by country and document. An ordinary or automatic translation is not a certified translation when certification is required.

What happens next

File only through the confirmed method. Keep a copy of the submission, case/application number and proof of receipt. Ask how to check status, when to expect a reply and what to do if more information is requested.
